Some important changes regarding smoking and vaping are coming to Oakville.

On June 24, 2019, town council approved a by-law revision (to by-law 2013-013), in order to include regulations for smoking cannabis and vaping at parks and recreation facilities in Oakville.

The amendment notes that, no person in any park will be allowed to smoke tobacco, cannabis, or use an electronic cigarette in any area where there are signs prohibiting smoking.

In addition, smoking, smoke tobacco, cannabis, or the use of an electronic cigarette in any area within 20 metres of a playground, splash pad, basketball court, tennis court, sports field or any sporting area, spectator area adjacent to sporting area, area primarily used for the purposes of children’s recreation, or other place where children tend to congregate is prohibited.

These changes (outlined in by-law 2019-065) were made to the subsections 11(c) and 11(d) of by-law 2013-013. And, according to the town, all other provisions of by-law no. 2013-013 will remain in force and effect.

The previous by-law subsections were as follows, according to the town of Oakville.

11. No person shall, in any park:

(c) smoke or carry a lighted cigarette, cigar or pipe in any area where signs are posted prohibiting smoking;

(d) notwithstanding whether any signs are posted prohibiting smoking, smoke or carry a lighted cigarette, cigar or pipe in any area within nine (9) metres of a playground, splash pad, basketball court, tennis court, sports field or other place where children tend to congregate.

According to a recent news release, “The new regulations are consistent with the Smoke Free Ontario Act which prohibits vaping and cannabis use anywhere smoking is prohibited, including 20 metres from all playgrounds and sporting and spectator areas.”
